
Can You Sue El Paso City For Pothole Damage?
Dodging potholes has practically become a sport in El Paso.
El Paso has somehow become the center of the pothole universe. If you hit one big enough to cause damage or injury, can you sue the city of El Paso?
YES ... but good luck winning the case.
Seriously, we should change the name of El Paso to El Pothole. We have zillions of them and flattened or damaged tires, banged up suspensions and even cracked frames are just a few things they can do to your car.
If you hit one that does mess up your car or injures someone in it, you can go after the city of El Paso but it's an uphill battle and the odds of winning aren't that great.
Attorney Daniela Labinoti recently said "It's not easy to sue the government," emphasizing the challenges due to the government's resources and legal protections".
What Does That Mean?
What it comes down to, really, is money. Let's say you hit a pothole that takes out your front tires. What the heck, let's say it takes out all 4 of your tires. You're probably looking at somewhere between $500 - $1,000 bucks.
That's a hit to the wallet but the average lawyer will charge anywhere from $100 to $400 dollars an hour ... for Lord knows how many hours ... plus there are court costs, filing fees, retainer fees and other stuff to lump in there. If you want to give it a shot, click here.

You can represent yourself but are you ready to take on a professional attorney? 'Cuz, the city has loads of 'em. Even if you win, you still have court costs and stuff. Basically, getting several hundred dollars worth of tires replaced could cost you thousands.
