
Did El Paso Construction Break Your Car? Make Texas Pay
It seems like every freakin' road in El Paso is being worked on these days and it's taking a toll on our nerves, tempers and vehicles.
Between the torn up roadways, pieces of steel laid over big, construction related holes and openings, construction equipment and a lot of other crap; our cars, (especially the windshields), are taking hits.
If yours was damaged in a construction related manner, you may be able to have Texas pay to fix it. Here's how ...
When I say you may be able to bill Texas, know that I write that with a lot of emphasis on the "may". It seems to be a bit of a long shot as the TXDoT website says right off the bat that they "aren't allowed" to pay you.

The Texas Civil Practice and Remedies Code §101.021 does not allow TxDOT to expend state funds for damage to property (e.g. vehicles) that is sustained as a result of highway conditions. If desired, you should contact your insurance company, and report the incident of property damage to them. - txdot.gov
Still though, there seems to be a tiny glimmer of hope for you. Click here to get to the correct page of the TXDoT website and then click the appropriate header. (Probably "other".)
You can also fax your claim to (512) 416-3302 or mail it to:
- Texas Department of Transportation Occupational Safety Division PO BOX 149148 Austin, TX 78714-9148.
Be sure you include a letter with all the details including the location. (mile marker, exit number, cross street, county, etc.), and the damage caused. Don't forget your info either: name, address, phone number(s), email, etc.
Don't send photos, estimates or any other documents because you won't get them back. TxDOT will reach out within 10 to 15 business days. If it was a city project; you'll have to file a claim here.
