New Mexico Marijuana Grower Suing State For Destroying Pot
Cops in New Mexico seized and destroyed tens of thousands of pounds of pot in the largest operation of this kind in New Mexico since new marijuana laws began in 2021.
Dozens of New Mexico State Police officers raided NNK Equity LLC as the state Cannabis Control Division began the process of revoking the license of cannabis grower NNK Equity LLC.
ABC reported that the company which grows marijuana to sell to dispensaries was "accused of not posting its licenses on site, failing to obtain water rights for cultivation, not having cameras that could monitor certain areas of its operation and violating sanitation and health requirements".
A Cannabis Control Division compliance check last summer allegedly found NNK had way more plants than legally allowed and were growing some of those in an unlicensed location so they seized all the mota. See the (almost painful) photos here and here.
NNK is now suing for hundreds of thousands of dollars in damages.
Jacob Candelaria, an Albuquerque attorney who represents NNK Equity, disputed the state's claims and accused regulators and state police of violating his client's civil rights. He said the state failed to properly serve notice of its intent to revoke the company's license and subsequently denied a request for a hearing on the merits of the case. - ABC
Candelaria added that NNK's owners speak only mandarin Chinese and that the New Mexico regulators failed to provide a translator as requested. He also pointed out that a situation where cops can destroy property based solely on a restraining order ... which the law doesn't require all parties even be told about ... is a major concern for all.
