Is it possible to have a blood-alcohol content over .08 without ever having a drink? Why yes. Yes it is. It's called "auto-brewery syndrome."

A woman in Albany, NY actually used this defense to get out of a DUI after her lawyer submitted medical evidence that his client had a BAC of four times the legal limit, without ever drinking an ounce of alcohol.

The condition is believed to be caused by excess yeast in the gut. The woman is now on a low-carbohydrate diet to help keep the condition under control.

My first question about this is, if you are brewing alcohol in your own gut, wouldn't that still get you drunk? And if so, how would you not pick up on this sooner? "Oh I'm just gonna have some bread." HAMMERED! I mean, holy balls, FOUR times the legal limit!
