Joshua Homme + Scott Reeder File Lawsuit Against Kyuss Lives!

One-time Kyuss members Joshua Homme (guitars) and Scott Reeder (bass) have filed a federal lawsuit against Kyuss Lives!, featuring singer John Garcia and drummer Brant Bjork. The pair was forced to bring legal action against their former bandmates for perpetrating what they believe is trademark infringement and consumer fraud. They also contend that this was the last thing they wanted to do. However, they were left with no choice but to take it to the courts.

Garcia and Bjork have been touring as Kyuss Lives!, performing songs from the legendary stoner rock band’s catalog. While the singer initially said that there is no Kyuss without Homme -hence, the formation of Kyuss Lives!- some shady actions appear to have taken place regarding the ownership of the name and an attempt to hijack it, resulting in this suit.

Homme, frontman for Queens of the Stone Age, as well as a member of Eagles of Death Metal and Them Crooked Vultures, and Reeder issued a statement on the matter via their publicist. It read as follows:

“It sucks. To think we went to a meeting in January solely to help them with their request to continue Kyuss Lives! With open arms, we made every attempt to help them continue Kyuss Lives! respectfully. Only to discover while they looked us in the eye, Kyuss Lives! management and band had filed federal documents in 2011 in an attempt to steal the name Kyuss.

This is desperately what we were trying to avoid. It’s a sad day for us and for John but most of all for the fans. What a needless mess.”

In other QOTSA legal news, ex-bassist Nick Oliveri entered a not guilty plea to multiple charges relating to a police standoff during a domestic dispute with his girlfriend.
